Employer Obligations Checklist

Communication between you, your employee, your doctor and Xchanging is very important for organising and maintaining a return to work. To assist in the management of your work related injury it is important to:

  • Implement first aid procedures as appropriate, and if the type and severity of the injury requires it report to WorkSafe Victoria.
  • Complete the Incident Notification Form (PDF 250KB) as required by workers’ compensation legislation.
  • Contact the worker to find out how they are, how your organisation can help, what their understanding of the diagnosis and prognosis is? Ask other relevant questions that will assist in the investigation of the circumstances that led to the injury.
  • Contact the worker’s doctor to find out from them, how their patient is, how your organisation can help, the doctors understanding of the diagnosis, prognosis and future return to work prospects?
  • Take practicable action to control any hazards to ensure that the risk of a subsequent injury of that kind in the future is reduced.
  • Prepare for a safe and early return to work by implementing and/ or developing a return to work plan which must be submitted to Xchanging within 20 days.
  • Claim forms - Ensure that a claim form is completed and submitted as soon as possible.
  • Claims for ‘Time Lost’ must have a Workers Claim for Compensation Form (blue) and a Certificate of Capacity (medical certificate)
  • Claims for ‘Medical Expenses Only’ require the Worker’s Claim Form (blue) clearly indicating that it is a claim for this purpose only.
  • Submit all documentation when:
    • It is expected that more than 10 days lost time will result; and/or
    • Medical expenses have or expected to exceed the threshold ($564.00*); and/or Where the claim is to be disputed.
    • This must be done within 10 days of the claim being received. Lodgement as early as possible is critical as fines can be imposed by WorkSafe Victoria.
